In February of 2009 the American Reinvestment and Recovery Act (ARRA) set aside more than $19 billion in funding for medical services providers that make "meaningful use" of "certified" EMR systems.
In January of 2010, draft definitions were published for both "meaningful use" ([1]) and "certified EMR" ([2]). Final rules are expected in June 2010.
The rules for certification and meaningful use are significantly different, especially in the area of information security. Meaningful use requires a risk assessment that complies with 45 CFR part 164.308, while certification has no such requirement. As the excellent AHIMA whitepaper on meaningful use ([3]) comments, "...such an assessment would not only include security as it relates to the EHR, EHR modules, and other technology, but also the full hospital system that is affected by the increase or introduction of EHR technology as required for meaningful use."
